WhatsApp Wins Legal Battle Against NSO Group

Court ruling strengthens user privacy rights and deters spyware firms nationwide.

WhatsApp has achieved a landmark victory against the NSO Group, bolstering user rights and serving as a potential deterrent to similar spyware companies. A U.S. court has ruled decisively against the Israeli surveillance software developer, finding them in violation of hacking protections and WhatsApp’s terms of service.

The case, heard in the U.S. District Court for the Northern District of California, centered around the use of the notorious Pegasus spyware, which has been implicated in serious human rights violations. According to reports, the NSO Group used this software to infiltrate more than 1,000 devices, allowing unauthorized access to encrypted messages and enabling remote activation of cameras and microphones.

Judge Phyllis Hamilton presided over the case and dismissed all of the NSO Group's defenses, concluding the company had likely had access to the software prior to users accepting WhatsApp’s terms of service. This judgment escalates the stakes for the NSO Group, which has already been placed on the U.S. Department of Commerce's blacklist due to its involvement in human rights abuses.

WhatsApp expressed relief and satisfaction with the tribunal’s decision. "WhatsApp will hold NSO Group accountable for its unlawful activities," they stated, underscoring the company’s commitment to protector user privacy. The support from tech giants like Apple and Amazon highlights the extensive repercussions of this ruling across the industry.

This legal battle was ignited by revelations from the Financial Times in 2019, which exposed how the NSO Group had exploited WhatsApp’s services for illicit operations. John Scott-Railton, from the Citizen Lab at the University of Toronto, referred to the ruling as groundbreaking, emphasizing its potential to deter unscrupulous spyware companies. "This ruling sends a strong signal to other companies attempting to deploy such technologies," Scott-Railton noted.

The court’s findings also highlighted the NSO Group's failure to present key evidence, including the Pegasus source code, which significantly weakened their position. The imminent trial will now focus on the extent of damages to be awarded to WhatsApp, setting the stage for potential financial and operational fallout for the NSO Group.
