Mountain West Conference Finds No Evidence Of Misconduct

Investigation clears San Jose State volleyball players amid allegations of manipulation

The Mountain West Conference has officially closed its investigation concerning allegations made against volleyball players from San Jose State University (SJSU) and Colorado State University (CSU). The case centered around claims brought by San Jose State associate head coach Melissa Batie-Smoose, who filed a Title IX complaint asserting misconduct during their match on October 3, 2024, which had raised serious concerns about integrity and competition manipulation.

On October 29, Batie-Smoose reported her allegations, claiming players had conspired to influence the game's outcome, particularly to target SJSU co-captain Brooke Slusser. Shortly after these allegations came to light, the Mountain West initiated a detailed investigation involving discussions with both coaching staffs, players from both teams, and outside experts to analyze match footage and other relevant materials.

According to Deputy Commissioner Bret Gilliland's release, the inquiry concluded there was not enough evidence to support Batie-Smoose's claims. He stated, "Upon receipt of this information, the Mountain West Conference office, in coordination with both member institutions, immediately initiated a thorough investigation." The formal report emphasized the comprehensive nature of the investigation, which led to the determination of no wrongdoing.

San Jose State acknowledged the conference's findings, stating, "We appreciate the thorough and impartial investigation conducted by the Mountain West Conference. The report is consistent with our internal conclusions." The conclusion of no disciplinary action has allowed the conference office to declare this matter resolved.

This latest incident occurs during what has been both a challenging and competitive season for the Spartans, which currently boasts a 14-5 record. The team rebounded from the earlier match loss against CSU with a victory later on, showcasing resilience throughout the season, even amid the fallout from these accusations.

While this investigation dominated discussions, it is not the only issue the Spartans face this season. Notably, five other teams within the Mountain West have recently canceled matches against them, citing meaningful concerns about fairness and justice for female athletes. This includes players from Nevada who made claims against SJSU’s inclusion of transgender athletes, leading to several forfeits officially recorded as wins for the Spartans due to the cancellations.

Beyond the on-court dynamics, tensions within the league have led to legal challenges. Recently, some players filed lawsuits against the NCAA relating to their experiences and feelings about inclusion and fairness, particularly concerning the participation of transgender athletes like SJSU’s Blaire Fleming, whose presence on the team has stirred significant debate and controversy.

Fleming’s name has surfaced repeatedly as part of the narrative surrounding these allegations, included within both the Title IX complaint filed by Batie-Smoose and the recent lawsuit involving multiple plaintiffs. Despite media reports, neither San Jose State nor the teams against which they played have confirmed her inclusion as the first transgender player on their volleyball roster. The Associated Press has opted to withhold her identity, complying with her wish for privacy.

Just as the Mountain West approached its findings, the details surrounding the lawsuits continue to ripple through the sports community. A Colorado lawsuit filed by 12 women demands the exclusion of the transgender athlete from upcoming championships set to take place from November 27-30, highlighting the contentious nature of the situation. San Jose State head coach Todd Kress has spoken out, supporting the investigation's conclusion, stating, "The findings from the Mountain West’s investigation on this matter are consistent with our own internal conclusions and my review of the game film with Colorado State's head coach." Kress emphasized the importance of maintaining integrity and fairness within the sport, reaffirming his commitment to the team's values as they look forward to their championship opportunities.
