Kamala Harris Faces Immigration Policy Backlash

The Vice President's promises clash with the Biden administration's controversial actions on border control

With the U.S. immigration policy under intense scrutiny, the Biden administration's approach seems to be stepping beyond the boundaries of established legal frameworks, igniting debates within political circles. Vice President Kamala Harris, known for her bold stances during her 2019 presidential run, finds herself at the center of this contentious dialogue, particularly as she attempts to distance herself from her past radical comments on immigration.

Harris’s strategy appears to be playing to her current audience as she prepares for the general election, making promises to 'follow the law.' This statement is significant, considering the actions taken by the administration to manage immigration at the southern border. Despite Harris's assertions, critics argue the administration is misapplying existing laws rather than adhering to them.

Federal law is quite explicit concerning how the U.S. deals with individuals illegally crossing the southern border. Those encountered by Border Patrol, regardless of their circumstances or claims of fear of returning home, are supposed to be detained until they either are deported or granted asylum. The Biden-Harris administration, instead, has been accused of sidestepping these laws, opting instead for mass releases of migrants, claiming to utilize the parole system.

At the heart of this immigration discussion are two controversial programs implemented under the Biden administration: the CHNV parole program and the CBP One app parole program. These programs allow for certain migrants, particularly from countries like Cuba, Haiti, Nicaragua, and Venezuela, to enter the U.S. without technically 'crossing' the border illegally, as the administration frames their entry as legal due to the parole designation, regardless of their inadmissibility status. This maneuvering has raised eyebrows among political opponents, who suggest it decriminalizes illegal border crossings.

To elaborate, the CHNV program permits sponsors within the U.S. to bring inadmissible migrants to the country, effectively offering them access to work permits, food assistance, and other societal benefits. This situation arises because the verification process against the Department of Homeland Security (DHS) databases largely overlooks potential criminal histories native to the sponsoring individuals’ home countries.

Similarly, the CBP One program enables migrants to request appointments with Border Patrol agents at designated posts along the border—the assumption being they remain at or near the Mexico border. Once migrants present themselves at these appointments, they, too, can bypass the once-necessary detention process, complicity leading to the perception of legally crossing the border.

This has sparked comparisons to former President Barack Obama’s approach to immigration. The Deferred Action for Childhood Arrivals (DACA) program established under Obama also utilized executive authority to shield certain undocumented individuals from deportation. The legal basis for DACA hinged on the principle of prosecutorial discretion, claiming the right to prioritize enforcement actions. Critics of the Biden administration’s recent policies argue these approaches do little more than replicate past administrations' shortcomings, which have consistently altered necessary legal ramifications through executive action rather than legislative processes.

Critics, particularly from opposition parties, contend Harris’s promise to abide by immigration laws is disingenuous. It seems her administration's steps lead to the opposite effect of enforcing compliance with immigration statutes. Many are fearful these policies don’t just contravene established immigration protocols but also create uncertain futures for both migrants and those citizens trying to navigate the legal immigration process.

The political ramifications of these policies can loom large. The Biden-Harris administration is striving to project humanitarianism and leniency, appealing to progressive values and typically liberal voter bases. Yet, as the election year approaches, it'll be interesting to see how this balancing act plays out with more centrist and conservative voters.

Harris is aware of the stakes involved. While she had espoused radical immigration policies during her former presidential campaign, she must now contend with the realities of governance, where promises must align more closely with legal expectations and voter perceptions.

To sum it up, the immigration policies proposed and enacted by the Biden administration are currently heavily contested and give rise to questions surrounding legal adherence, efficacy, and the methods employed. Kamala Harris’s past and present statements reflect the complexity of this issue, underscoring the very real political and personal stakes involved as the country moves closer to the 2024 election. The pressing question of whether the administration will strike the right balance between enforcement and empathy remains, and how the public perceives these efforts could significantly influence future electoral dynamics.
