Elon Musk's $1 million sweepstakes raises legal concerns as DOJ investigates potential election law violations

The Justice Department has sent a letter to Elon Musk's political action committee, America PAC, indicating serious concerns over his recent $1 million sweepstakes aimed at registered voters in swing states. The program, which Musk launched to encourage voter registration and support for the First and Second amendments, raises questions about its legality under federal election laws.

Launched over the weekend, Musk's initiative promised to award $1 million daily to randomly selected swing-state residents who agreed to sign the PAC's petition. This unusual approach has garnered attention as both branches of federal law enforcement examine its compliance with regulations.

According to sources familiar with the matter, the letter from the DOJ's Election Crimes Branch warns Musk's PAC about potential violations of federal law, particularly one prohibiting payments for voter registration. To qualify for the lottery, participants must be registered voters, which legal experts assert might breach the law's stipulations.

The sweepstakes has already awarded four $1 million checks, yet the DOJ's inquiry adds uncertainty to the contest. Observers from various sectors, including election law experts and politicians, have raised alarms about the sweepstakes, emphasizing the precedent it might set for future political campaigning.

Musk, who has openly supported former President Donald Trump, seems unfazed by the scrutiny. He contends the program is legal and maintains it intends to mobilize up to two million voters by the time polls open on Election Day, which falls on November 5.

"We want to try to get over one million, maybe two million voters to sign the petition supporting the Second Amendment and the First Amendment right to free speech," Musk articulated during his announcement of the contest, which took place at a campaign stop in Harrisburg, Pennsylvania. The emphasis here is on freedom of expression and gun rights, reflective of Musk's political alignments.

While Musk's PAC claims the initiative is above board, some lawmakers and former prosecutors believe otherwise. A group of Republican ex-prosecutors prompted the DOJ to investigate the legality of Musk's action, stating there is “nothing like this in modern political history” and urging the department to probe any potential violations.

Federal law is fairly stringent on these issues, declaring it illegal for anyone to pay for voter registration or for votes. Specifically, it states, "Whoever pays or offers to pay or accepts payment either for registration to vote or for voting...shall be fined not more than $10,000 or imprisoned not more than five years, or both." Given these boundaries, Musk's contest appears to toe the line, raising alarms from seasoned legal professionals.

Many experts argue the language Musk uses opens doors to legal loopholes. For example, rather than explicitly paying for registrations, he redefined the contest by framing the payments as compensation for the winners' roles as spokespersons for America PAC. Winners must not only accept the funds but also produce campaign-related content, which has already begun alongside the giveaway.

Nonetheless, uncertainties surrounding the legality of this charitable contest linger. Commenting on the potential violations, Paul Schiff Berman, a law professor at George Washington University, pointed out, "The offer's only open to registered voters, so it may contravene this provision. The DOJ could very well decide to take action here."

Adav Noti from the Campaign Legal Center stated, "It is illegal to give out money on the condition recipients register as voters," pushing for immediate scrutiny of Musk's activities. Despite these warnings, Musk has pushed back, asserting, "You can be from any or no political party and don’t even have to vote to win. It’s just about getting people involved."

The contest targets voters from seven strategically important swing states: Pennsylvania, Georgia, Arizona, Nevada, Michigan, North Carolina, and Wisconsin. These states are seen as pivotal for Trump's 2024 presidential campaign and by extension Musk's investment of resources.

While the contest appears innovative, it sits uncomfortably within the broader legal and ethical confines of fundraising and election law. Critics probe its legitimacy, and the DOJ's involvement has only intensified scrutiny on Musk's growing political activism.

Overall, Musk's push for voter participation through financial incentives presents new questions about election law and ethical campaigning. Should this sweepstakes withstand legal tests, the precedent it sets could transform the framework within which financial contributions are integrated during electoral processes, particularly among notable public figures advocating for candidates.

With just weeks remaining until the eventful November elections, the situation can evolve rapidly. It remains to be seen what actions, if any, the DOJ will pursue against Musk and whether Musk’s ambitious lottery plan becomes the subject of major legal battles.

For now, this scheme serves as both spotlight and lightning rod, illustrating the complex interplay between wealth, politics, and legal frameworks governing electoral integrity.

While representatives from Musk’s PAC did not return inquiries about the DOJ's letter, political analysts will closely monitor how Musk navigates this developing situation as Election Day approaches.
