Alec Baldwin Manslaughter Case Officially Dropped

Prosecutors withdraw appeal, concluding nearly three years of legal proceedings following the tragic death of Halyna Hutchins.

Alec Baldwin's legal battles surrounding the tragic shooting of cinematographer Halyna Hutchins on the set of the film Rust have reached a dramatic conclusion, with New Mexico prosecutors officially dropping their appeal of the involuntary manslaughter case against the actor. The announcement, made by special prosecutor Kari Morrissey, signals the end of nearly three years of criminal proceedings following the accidental shooting incident.

The death of Hutchins, who was killed during rehearsals for Rust on October 21, 2021, has become infamous within the film industry for its unexpected nature and the subsequent scrutiny it placed on on-set safety protocols. The decision to withdraw the appeal came after the state attorney general's office decided they would not pursue the appeal vigorously. This follows Judge Mary Marlowe Sommer's dismissal of the charges mid-trial, where she criticized the prosecution's handling of evidence. The prosecution had faced backlash for not disclosing significant evidence to Baldwin's defense, with the judge stating their conduct “so near to bad faith as to show signs of scorching,” as reported by Variety.

Baldwin's attorneys, Alex Spiro and Luke Nikas, declared the withdrawal of the appeal as “final vindication,” reiteratively stating their client committed no crime throughout the ordeal. “This was an unspeakable tragedy but Alec Baldwin committed no crime,” they emphasized, reinforcing Baldwin's stance on his innocence. The case stirred widespread interest not only due to Baldwin's high-profile position within the industry but also due to the peculiar circumstances surrounding the shooting, especially as it involved the use of weapons on set.

While Baldwin is cleared of criminal charges, the civil litigation initiated by Hutchins’ family against him and the film's production continues. Victims' rights attorney Gloria Allred, representing Hutchins' family, expressed disappointment at the prosecutor's decision not to appeal, describing it as having violated the rights of Hutchins' relatives. At a Los Angeles news conference, she reaffirmed their intentions to pursue damages from Baldwin and stated, “Mr. Baldwin must be held accountable.”

The Hutchins family aims to have Baldwin answer questions under oath during the civil proceedings, arguing for compensation due to the tragic loss of their family member and the close relationship they shared. The family had previously reached a legal settlement with Baldwin separately, but the path for filing civil suit remains open following the dismissal of criminal charges. Allred has stated the importance of this step, asserting, “With the withdrawal made public yesterday, we can now proceed with our civil case.”

Allred did not shy away from criticizing the New Mexico Attorney General Raúl Torrez, labeling his decision not to continue the appeal as “the Grinch who stole Christmas” during her press appearance. This pointed remark came as Torrez defended the decision, highlighting “significant procedural irregularities” noted by the judge when dismissing the criminal case. Torrez's office emphasized they would not prolong the families’ grief over what had been deemed “a compromised criminal case.”

The case has sparked concerns over safety measures on film sets, particularly with the use of firearms. Baldwin has maintained his account of the incident, asserting he pulled back the hammer of the pistol but did not pull the trigger. Yet investigators, including the FBI, have concluded the firearm would not discharge without the trigger being pulled. This incident marks one of the only on-set fatalities due to gun misuse since the silent film era, drawing comparisons to past incidents such as the death of Brandon Lee on the set of The Crow back in 1993.

Meanwhile, Hannah Gutierrez Reed, the film's armourer who loaded the weapon with the fatal bullet, has begun serving her 18-month sentence for involuntary manslaughter. The complex narrative surrounding this case reflects the rising tension and urgent conversations about safety practices within the film industry.

Now, with the criminal case effectively closed, all eyes will turn to the pending civil action where the Hutchins family aims to seek justice through litigation. Despite the resolution of the criminal charges, Baldwin's representation has emphasized the enduring tragedy of the situation. This incident has cast long shadows over Rust and its production team, making safety protocols and the handling of firearms front and center in discussions within Hollywood and beyond. The industry will likely continue to grapple with the ramifications of such tragic events, ensuring the mistakes of the past do not repeat themselves.
