Vietnam Implements New Military Allowance Regulations

Recent laws signal commitment to fair military compensation and accountability standards.

The Vietnamese government has introduced significant changes affecting military personnel with the approval of Decree No. 16/2025/ND-CP, which will take effect on March 23, 2025. This new regulation establishes specific one-time allowances for full-time militia members who have served and are recognized for completing their military duties during peacetime.

According to the decree, the amount allocated will be 4,680,000 VND for each year of service. This compensation reflects the government's commitment to properly remunerate its militia members. For those who have served for odd months, allowances are calculated differently. Under one month of service, no payment will be issued. For service ranging from one to six months, members will receive 50% of the one-year service allowance, whereas those who have served from 7 to 11 months will be compensated fully as though they have completed one full year.

Such adjustments are part of broader efforts by the Vietnamese government to refine policy regulations surrounding military service, showcasing respect and acknowledgment for the contributions of militia personnel to national security. This regulation aims to provide clarity and fairness to compensation, ensuring military members receive their rightful allowances, which is particularly important for those who may have served shorter terms.

Alongside the new allowance framework, the Ministry of National Defense has also taken steps to address legal standards concerning democratic practices within the army. Circular No. 122/2024/TT-BQP, effective from December 31, 2024, dictates how breaches of laws pertaining to democratic engagement should be handled among military personnel. This circular outlines the responses to violations of regulations governing democratic practices.

Military personnel, along with national defense workers and officials, who commit legal infractions concerning democracy, face various penalties extending from disciplinary action to administrative sanctions and, potentially, criminal prosecution. The significance of these measures is underlined by the necessity for all military personnel to act within the confines of the law, promoting not just good governance but also accountability within the ranks.

If these violations result in harm or damage, the responsible parties must provide compensation as dictated by existing legal guidelines. Organizations or units within the military found culpable of similar transgressions will be subject to regulations outlined by army directives and must also adhere to compensation laws if damages occur.

The implementation of these laws signifies the government’s resolve to not only compensate its service members fairly but also to instill disciplinary structures aimed at preserving order and integrity within the armed forces. Upholding democratic practices not only fortifies the military framework but also aligns military operations with civilian democratic values, fostering confidence among citizens.
