Trump's amicus brief submitted to the Supreme Court requests the court to stay the Act’s deadline for divestment until Jan. 19, 2025, pending the resolution of the broader case concerning TikTok’s operations within the U.S. The brief argued, “President Trump takes no position on the underlying merits of this dispute.” This statement reflects Trump's strategy to navigate complex legal disputes without taking definitive stances until he assumes office. The request came just as TikTok and the Biden administration filed opposing briefs, emphasizing the legal stalemate surrounding the app due to national security concerns.

According to The Washington Post, TikTok's legal team contends the federal appeals court erred by ruling based on assumed risks of potential control from China over TikTok. The Biden administration argues the app threatens national security risks, citing lacking empirical evidence but emphasizing its corporate ties to ByteDance, the China-based parent company.

Trump's involvement with TikTok is notable, as he has altered his stance since attempting to prohibit it during his first term. Previously apprehensive about TikTok's ties to China, Trump now embraces the platform as part of his campaign to engage younger voters.
