According to reports, Tickle's account on Giggle for Girls was blocked after seven months of use, raising concerns about gender-based discrimination. The app requires users to provide photos of themselves, which are then screened by artificial intelligence (AI) to verify their gender identity. Initially accepted, Tickle alleged her account was revoked due to the platform's perception of her as male.

Justice Robert Bromwich presided over the case and ruled it was unlawful discrimination to remove Tickle based solely on her gender identity. Rather than dismiss her claim entirely, the court found adequate grounds for 'indirect gender discrimination,' as Tickle was effectively required to present as a cisgender woman to use the app. The court ordered Giggle's owner, Sall Grover, to compensate Tickle with $10,000 AUD (approximately $6,700 USD) and legal costs, but did not require her to issue any formal apology, deeming such an action inappropriate.

The crux of the ruling shifted the conversation surrounding gender identity and sex. The judge referenced previous case law dating back over 30 years, which has recognized the complexity of gender, stating, "Those arguments failed because the view propounded by the respondents conflicted with... cases established... sex is changeable." Roxanne Tickle has lived openly as a woman since 2017. She underwent gender-affirming surgery two years later and has maintained her legal status as a female. "There is so much hate and bile cast on trans and gender diverse people simply because of who we are," Tickle shared.
