TikTok Takes Legal Stand Against US Ban

The popular social media platform defends its position against claims of national security risks and challenges ownership laws

TikTok is ramping up its legal defenses as the future of its platform hangs precariously to the whims of the U.S. government. Following claims by the Department of Justice (DOJ) stating the app poses national security risks due to its ties with the Chinese government, TikTok is asserting its rights to challenge these allegations.

On August 15, TikTok filed court documents urging federal appeals judges to block laws dictitating the divestment of its parent company, ByteDance. The platform argues it towers above such restrictions, describing itself as fundamentally American, albeit foreign-owned.

According to TikTok, the premise of moving to ban the app fails on the grounds of actual evidence. The latest filings articulate the company’s contention, stating the government has not substantiated its claims about the alleged storage of sensitive American data by ByteDance.

The U.S. DOJ’s case leans heavily on concerns surrounding TikTok's ownership, arguing it operates as one entity with potential accessibility for the Chinese government. TikTok’s legal team, on the other hand, insists it deserves First Amendment protections similar to other foreign-owned media platforms like Politico and Business Insider.

To bring strength to its claims, TikTok's attorneys noted foreign ownership has not stripped media outlets of their constitutional rights, asserting there's no legal precedent for the government's stance. "No precedent supports the government's dramatic rewriting of what counts as protected speech," the company’s representatives stated.

Conversations between the Biden administration and TikTok have trailblazed this dispute, with the deal between them taking center stage. Both parties were unable to reconcile their differences over proposed regulations, with TikTok attempting to address the government’s security concerns.
