Texas Takes Legal Action Against TikTok Over Child Privacy

The lawsuit accuses TikTok of failing to protect minors' personal data under state privacy law

Texas has taken legal action against social media giant TikTok, accusing the platform of violating the state’s new law aimed at protecting children’s online privacy. Attorney General Ken Paxton formally filed the lawsuit this past Thursday, claiming TikTok has been collecting and sharing personal information from minors without proper parental consent. This lawsuit raises significant concerns about how social media platforms handle the sensitive data of young users, echoing broader debates about privacy and online safety.

The lawsuit centers around the Securing Children Online through Parental Empowerment (SCOPE) Act, which was enacted on September 1, 2024. This law sets stringent requirements for digital platforms, mandatorily obliging them to obtain explicit parental permission before collecting personal information from children. According to Paxton, TikTok has failed to adhere to these regulations, jeopardizing the safety of Texas minors.

The SCOPE Act comprises several measures aimed at safeguarding children. It mandates digital service providers to offer tools for parents and guardians to oversee their children’s online activities and manage privacy settings. Specifically, it prohibits companies from sharing, disclosing, or selling minors’ identifiers—such as names, contact details, and even more nuanced data like device settings—without consent from the child’s verified parent or guardian. The Texas Attorney General’s office highlighted this failure as integral to his legal case against TikTok.

Penned within the lawsuit are claims of three key violations under the SCOPE Act: Firstly, TikTok is said to have not provided adequate tools for guardians or parents to confirm their identity and relationship to minors using the platform. Secondly, it allegedly shared personal data without proper authorization, and thirdly, the platform has fallen short in offering parental supervision tools necessary for controlling minors’ account privacy settings.

The financial repercussions tied to these allegations could be staggering. Paxton's office is pursuing civil penalties of up to $10,000 for each violation, which could amount to significant financial liabilities for TikTok if the state prevails.

Despite the serious nature of the allegations, TikTok has yet to publicly comment on the lawsuit. This case adds to the growing scrutiny faced by the social media platform, which has recently dealt with similar legal and regulatory challenges concerning the protection of minors. Earlier this year, similar bills were introduced by various U.S. states aiming to limit TikTok's operations due to privacy concerns.

Before the enactment of the SCOPE Act, previous attempts to restrict TikTok’s data practices were met with hurdles. Certain clauses of the SCOPE Act, especially those responsible for filtering harmful content, faced preliminary injunctions by judges, demonstrating the legal challenges surrounding social media regulation at the state level.

Currently, TikTok operates under significant pressure not only from Texas but from lawmakers across the nation who are eager to tighten regulations concerning data collection practices. The platform had already begun implementing changes in response to these new laws; for example, TikTok recently enhanced user privacy settings concerning minors, but the effectiveness and compliance of these measures are now under intense scrutiny.

Meanwhile, larger concerns loom over the overall safety of children on social media platforms. A rising number of young users on TikTok intensifies the urgency for lawmakers to act decisively. With children increasingly exposed to sophisticated online platforms, ensuring their safety and privacy through legislation has become more than just administrative oversight; it is viewed as integral to their wellbeing.

The emergence of the SCOPE Act and the lawsuit against TikTok is significant as it may set legal precedents not only applicable to Texas, but potentially across the United States. It serves as a reminder to digital service providers about the importance of adhering to regulations aimed at protecting young users from exploitation.

The lawsuit reflects not only Texas Attorney General Ken Paxton’s commitment to safeguarding children but also highlights the rising concern among parents and lawmakers about the ethical responsibilities of social media companies. Paxton stated, “TikTok and other social media platforms must prioritize the safety and privacy of our children. We will continue to hold them accountable.”
