A federal judge in Texas has temporarily halted the Biden administration's initiative aimed at providing legal status to spouses of U.S. citizens who are undocumented. This decision marks a significant setback for one of the administration's key immigration policies intended to ease pathways to citizenship.
On the decision day, U.S. District Judge J. Campbell Barker issued the pause, known as an administrative stay, just days after 16 states, spearheaded by Republican attorneys general, challenged the program. The policy was set to benefit nearly 500,000 undocumented spouses, and about 50,000 of their children. It would allow these individuals to apply for green cards without having to first leave the country and return.
Judge Barker’s ruling follows claims made by Texas and other states arguing the administration sidestepped Congress for political reasons and imposed undue financial burdens on states dealing with undocumented immigrants. Texas officials stated the state incurs tens of millions annually on healthcare and law enforcement related to this population.
President Biden unveiled the program, named Keeping Families Together, back in June of 2024, with the Department of Homeland Security beginning to accept applications shortly before the judge’s ruling. The court's order pauses the implementation for two weeks but could be extended as legal arguments develop. Barker noted, "The claims are substantial and warrant closer consideration than the court has been able to afford to date."
Judge Barker, appointed by former President Donald Trump, is situated within the 5th U.S. Circuit Court of Appeals, which tends to favor conservative legal perspectives. His ruling could play out with timing that's pivotal, potentially handed down just before the presidential election on November 5 or before the inauguration of any new president next January.
Under the policy, to qualify for legal status, undocumented immigrants must show they have resided continuously within the U.S. for at least ten years, possess no serious criminal history, and have been married to a U.S. citizen by June 17, 2024. They also faced various documentation requirements and application fees totaling approximately $580.
Traditionally, the process for gaining legal residency could lead to lengthy separations from families, with some required to remain out of the country for extended periods. The Keeping Families Together policy aimed precisely to mitigate this issue, allowing these individuals to remain with their families during their applications.
Texas Attorney General Ken Paxton, who has been vocal about opposing the program, celebrated the pause, indicating it as merely the first step in continuing the fight for what he termed “the rule of law.” He broadcasted his sentiments on social media, reinforcing the state’s resolve to challenge the Biden administration's policies.
Legal representatives and advocates for immigrant rights expressed deep disappointment with the judicial decision. Jessica Cisneros, representing the Texas Immigration Law Council, said, “The court’s decision tonight to halt the federal government from providing relief is devastating to the thousands of Texas families.”
Amid this courtroom tug-of-war, many families have already received notifications pertaining to their applications. Advocates have been rallying support for those immigrants whose lives and careers are significantly impacted by the legal battles surrounding this initiative.
Karen Tumlin, founder of the Justice Action Center, expressed her concerns stating, “Texas should not be able to decide the fate of hundreds of thousands of U.S. citizens and their immigrant spouses without confronting their reality.” This sentiment echoes the frustration of many families relying on this program to stabilize their immigration statuses and remain united.
The policy has ignited fierce debate within the political sphere, particularly as the election season grows intense. For many Republicans, the discussion centers around what they label as amnesty for undocumented individuals, fuelling calls for stricter immigration controls.
