Tenth Anniversary Of Custodial Hearings Highlights Efficacy And Issues

A decade of hearings reveals mixed results as Brazil grapples with justice system challenges.

Custodial hearings, established ten years ago to prevent illegal arrests and assess police conduct, have sparked significant dialogue and controversy across Brazil. According to data released by the National Justice Council (CNJ), over two million hearings have taken place since their initiation in February 2015, aiming for accountability within the justice system.

The hearings are intended to evaluate the legality of arrests within 24 hours and to address potential excesses by law enforcement. A recent CNJ study revealed intriguing statistics: preventive detention was upheld in 59% of cases, whereas 41% of detainees were granted freedom and 0.3% were assigned to house arrest. These figures challenge the prevailing narrative, often summarized as "the police arrest, and the courts release."

Luís Lanfredi, the coordinator of the Department of Monitoring and Inspection of the Prison System at the CNJ, articulated the hearings' importance, stating, "Nesses dez anos, as audiências demonstraram seu impacto na prevenção de prisões indevidas e na redução de ilegalidades." This translates to, "Over these ten years, hearings have demonstrated their impact on the prevention of undue imprisonments and the reduction of illegalities." His assessment underlines the hearings' role not just as legal formality but as judicial safeguards against human rights violations.

Despite the successes noted, the hearings are not without their criticisms. Reports indicate instances of torture or mistreatment occurring during 7% of hearings, amounting to nearly 153,000 documented cases. Judges conducting these sessions are mandated to inquire about any instances of police violence, emphasizing the hearings' dual purpose: to uphold the law and protect individuals' rights.

There has been tangible progress noted within the Brazilian prison system. The rate of provisional prisoners plummeted from 40% to 21% between 2014 and 2024, reflecting efforts to reduce overcrowding and improve detention conditions. This decrease is significant considering Brazil has long struggled with prison overcrowding and human rights abuses within its criminal justice framework.

The data also explored the nature of the crimes leading to custodial hearings. Notably, drug trafficking arrests comprised 24% of all cases examined since August 2024. Following drug offenses were charges for theft at 13%, domestic violence at 7%, and illegal arms possession at 6%. These statistics illuminate not only the types of crimes still prevalent but also highlight the focus of law enforcement efforts over the past decade.

Amongst the drugs seized during these incidents were substantial quantities of marijuana (42,700 cases), cocaine (40,200), and crack (21,100), illustrating the continuing challenges facing authorities combating drug-related crime.

With ten years of custodial hearings marking their anniversary, Brazil stands at a crossroads. While significant strides have been made, including reductions in unlawful detentions and improved judicial oversight, the enduring issues of corruption and violence within the policing system remain pressing concerns. Only time will tell how these hearings will continue to influence Brazil's complex legal and social landscapes.
