Smith filed his arguments on Monday with the 11th U.S. Circuit Court of Appeals, insisting Cannon's decision "deviated" from established legal precedent. Smith's brief contends the ruling did not adequately take historical practices and statutes supporting the attorney general's authority to appoint special counsels, claiming it lacked merit and was misplaced.

After Trump’s attorneys successfully argued for the dismissal, Cannon concluded last month, on July 15, 2024, citing the Constitution's Appointments Clause. She asserted Smith’s appointment violated this clause, which restricts the appointment of officials to inferior offices. Cannon, appointed by Trump himself, relied on this interpretation to dismiss the charges against Trump, including accusations of willful retention of national defense information and obstruction related to efforts by federal investigators.

Prosecutors argue the dismissal has far-reaching consequences, potentially invaliding the appointments of many key officials across various federal departments. They warn of broader institutional ramifications if Cannon's reading of the law is upheld.

Smith's defense will also reference the Supreme Court's 1974 ruling in United States v. Nixon, which affirmed the authority of the attorney general to appoint special prosecutors, marking this as an authoritative precedent. “The Attorney General validly appointed the special counsel, who is also properly funded,” Assistant Special Counsel James Pearce wrote. Following the recent dismissal of the criminal indictment against him, Trump voiced his intention to unearth what he referred to as "witch hunts" against him, reinforcing his claims of political targeting. Steven Cheung, Trump’s campaign spokesman, echoed these sentiments, framing the case as part of political maneuvers to undermine Trump’s reelection efforts.

The 40 counts against Trump stem from allegations involving the unlawful handling of around 300 sensitive records, with over 100 being seized during an FBI raid on his Mar-a-Lago estate. Convincing arguments have been laid out by Smith's team as they assert the ability of federal authorities to manage classified information by past presidents after leaving office. They stress the need for accountability when sensitive materials are involved.
