This issue reached new heights when the San Francisco City Attorney's office initiated lawsuits against 16 websites for generating AI-produced pornographic images of women and underage girls.
San Francisco City Attorney David Chiu announced the groundbreaking lawsuit, marking it as unprecedented. These websites reportedly allowed users to upload photos of real individuals, employing AI to create nude images without consent.
Chiu expressed horror over the capabilities of such websites, stating, "This investigation has taken us to the darkest corners of the internet... Generative AI has enormous promise, but as with all new technologies, there are unintended consequences and criminals seeking to exploit the new technology.”
Among the troubling findings, some websites explicitly marketed their services with phrases like, “Imagine wasting time taking her out on dates when you can use website x to get her nudes.” Chiu added, “Images are created without the consent of people depicted and are often indistinguishable from real photos.”
Collectively, these sites racked up over 200 million visits within the first six months of this year, affecting various celebrities, including Taylor Swift, and leading to incidents at schools across the nation. For example, at Beverly Hills Middle School, 16 images circulated among students, causing panic and distress.
The San Francisco Attorney’s office emphasized the serious repercussions of such actions, stating they contributed to bullying, humiliation, and even suicide attempts by victims. The lawsuit claims these websites violated laws against deepfake pornography, revenge pornography, and child pornography.
Operationally, the websites utilized older versions of AI models, like Stable Diffusion, to execute these invasive acts. Given the obscured identities of some website owners, Chiu's office aims to unearth more perpetrators through legal procedures.
Chiu firmly reiterated, “We have to be very clear: this is not innovation — this is sexual abuse.” Despite the potential risks of generative AI, the underlying exploitation of real individuals is alarming and needs urgent attention.
On another front, experts are considering watermarking as a potential solution to identify AI-generated content. Many lawmakers believe this could mitigate some of the ethical crises posed by AI-generated media.
Countries like China have already implemented bans on AI-generated media devoid of watermarks. The European Union has proposed regulations mandatorily tracking AI content, whilst American lawmakers have introduced acts aiming to initiate similar standards.
Watermarking, done either visibly or invisibly, poses its own sets of challenges. Visible watermarks can easily be cropped out of images, proving ineffective, whereas invisible options may be detected only through specialized software.
Yet, analysts warn even if watermarking became universally effective, it wouldn’t solve the core problems associated with AI-generated abuses. Labels like “AI-generated” wouldn't affect those with confirmation biases, allowing misinformation to persist.
The need for enhanced media literacy has been emphasized alongside discussions on intellectual property protection and content verification. Although the technology of watermarking is evolving, it’s clear additional strategies must accompany such measures to grapple with AI misuse.
