RTVE Fined Over One Million Euros For 'La Revuelta' Scheduling Breach

Despite high ratings, RTVE's failure to adhere to lottery airing schedules raises serious financial and political concerns.

RTVE, the Spanish public broadcaster, faces a massive financial penalty exceeding one million euros due to serious scheduling conflicts stemming from its hit show, 'La Revuelta,' presented by David Broncano. The trouble arose from RTVE's repeated failure to adhere to contractual obligations with Loterías y Apuestas del Estado (LAE), the state lottery operator, which dictated specific time slots for airing lottery draws.

Since 'La Revuelta' first aired on September 9, 2024, it has gained significant popularity, particularly for its interactive and comedic handling of state lottery announcements. According to reports by El Mundo, the show has aired these lottery results outside the agreed-upon timeframe over 20 times, violating the agreement stipulating the lottery draw be broadcast from 21:45 to 22:30 between Monday and Friday, lasting 75 to 105 seconds.

This breach has culminated in financial repercussions, with initial penalties assessed at 1.5 million euros before being reduced to just over one million after the public broadcaster appealed the fines. Sources indicate this was no accident; RTVE was aware of these scheduling hurdles yet continued to prioritize audience ratings over compliance. An internal message revealed the decision-makers accepted risks associated with these breaches to bolster the show's viewership.

The political fallout from this incident has been significant. The Popular Party (PP) has been vocal about holding RTVE accountable at the Senate’s Mixed Commission for the Control of RTVE. They described the situation as causing “serious economic harm” due to what they referred to as deliberate and repeated breaches of the contract. Mónica Hernández, from the PP, emphasized the need for accountability, stating, “The public deserves to know who made these decisions and why the warnings went unheeded.”

The issue isn’t new and has previously drawn warnings from the General Intervention of State Lotteries, which repeatedly cautioned RTVE about the consequences of failing to comply. Reports suggest the RTVE leadership ignored these alerts, continuing to allow 'La Revuelta' to alter the schedule to its advantage, leading to the current financial penalty.

The internal turmoil escalated after the November 2024 replacement of Concepción Cascajosa with José Pablo López as RTVE’s interim president. Lopez has since instituted new guidelines to mitigate similar occurrences, initiating measures to incorporate lottery results creatively within 'La Revuelta' without conflicting with broadcast contracts.

Under the revised agreement, lottery segments will air daily from 21:45 to 00:00, with recent modifications allowing the broadcast to extend across weekends. ‘La Revuelta’ now appropriately integrates lottery results as part of the show, featuring interactive segments during the draws themselves, with the presenter Jorge Ponce amusingly engaging viewers with comedic sketches.

Despite the creative method of airing the results, the previous approach has ignited heated debates surrounding the balance of entertainment and contract adherence. The success of 'La Revuelta' has been remarkable, drawing viewership from demographics previously disengaged from public television. Yet, this popularity came at the cost of stiff penalties, prompting discussions about enforcing contractual obligations without sacrificing innovative content.

The conundrum faced by RTVE emphasizes the difficulty of maintaining compliance with contracts whilst pursuing viewer engagement.
