OpenAI Fined $15 Million By Italy For Data Privacy Violations

The Garante uncovers serious breaches and mandates user education campaign.

OpenAI, the company behind the popular AI application ChatGPT, has been issued a staggering fine of €15 million (approximately $15.66 million) by Italy's data protection authority, known as the Garante. This decision, announced on December 20, 2024, stems from serious violations of user data privacy laws.

The investigation carried out by the Garante found evidence indicating OpenAI processed personal data from users without securing adequate legal bases, effectively breaching privacy principles and obligations tied to user information. The Garante explicitly stated, "OpenAI processed the personal data of users to train ChatGPT without having proper legal basis and violated transparency principles and obligations related to user information," as reported by EFE.

Notably, the authority raised alarms over OpenAI's failure to appropriately inform users of how their data was being processed. The Garante noted, "This is a blatant violation of fundamental rights to privacy and data protection," emphasizing the severity of OpenAI's transgressions.

Compounding the situation were concerns surrounding age verification measures within ChatGPT. The Italian regulators were particularly troubled by OpenAI's inability to implement effective mechanisms to verify the age of users, which has left minors as young as 13 potentially exposed to inappropriate content generated by the AI.

Equally troubling was OpenAI’s failure to notify users about a significant data breach identified as occurring back in March 2023. The Garante remarked, "OpenAI did not adequately notify about a data breach occurring in March 2023," underscoring the company's negligence.

To rectify these severe issues, the Garante mandated OpenAI undertake a six-month institutional communication campaign, aimed at informing users about their rights and the processes involved with data handling within ChatGPT. This campaign must be approved by the Garante and will focus on educating users about data collection, AI training practices, and their rights, including the ability to reject, rectify, or delete their information.

Alongside the financial penalty, this ruling marks a significant moment for privacy regulation within the technology sector, signifying the European Union's stringent stance on data protection compliance among AI platforms. The inquiry conducted by the Garante has also been forwarded to the Irish Data Protection Authority, which is the overseer of OpenAI’s European operations, signaling potential long-term impacts on the company's practices.

Experts argue this decision sets a powerful precedent, highlighting the increasing need for technology companies to implement transparent data handling practices and prioritize user privacy.
