Minnesota Supreme Court Hears Trans Powerlifter Discrimination Case

JayCee Cooper's lawsuit raises questions about rights and regulations for transgender athletes

On December 3, 2024, the Minnesota Supreme Court heard arguments concerning JayCee Cooper, a transgender woman and powerlifter, seeking to compete in women’s events after being barred from joining the women’s team of USA Powerlifting. The case has sparked significant interest and debate over transgender athletes' participation and the protections provided under the Minnesota Human Rights Act.

Cooper filed her lawsuit against USA Powerlifting back in 2021 after being denied entry to the women’s division. Her complaint alleges discrimination, claiming the federation’s actions violated her rights as outlined by the Minnesota Human Rights Act, which protects individuals from discrimination due to gender identity. According to Cooper's attorney, Jess Braverman, breaking down individuals based on assumptions about their physical abilities—whether they are transgender or not—was inherently discriminatory.

Upon initial review, the Ramsey County District Court sided with Cooper, determining the organization's actions constituted discrimination. The court mandated USA Powerlifting cease all discriminatory practices related to sexual orientation and gender identity, directly supporting Cooper’s claim about unfair exclusion.

USA Powerlifting, responding to the ruling, argued discrimination did not happen because their decision not to allow Cooper to compete was based on preserving fairness in the sport, not gender identity. They contended Cooper, having been assigned male at birth and having undergone male puberty, would possess inherent physical advantages over cisgender women participants.

Following the district court’s decision, USA Powerlifting appealed. While the Minnesota Court of Appeals did recognize the protection against discrimination for transgender individuals, it partially overturned the district court’s ruling, questioning whether the actions taken against Cooper amounted to discrimination.

On Tuesday, both sides presented their arguments in front of the state Supreme Court. Cooper's representatives highlighted instances where the federation’s intent to exclude her was clear-cut, citing direct statements from USA Powerlifting president, Larry Maile, affirming their policy against allowing transgender women to compete.

Defending USA Powerlifting, attorney Ansis Viksnins argued the organization's policy is grounded not only in biology but upholds the integrity of female sports. He insisted the differentiation was based on physical capabilities rather than gender identity, emphasizing the limitations imposed by biological factors.

The Supreme Court justices explored various facets of the case, grappling with the relief and ramifications of both sides' assertions. They posed probing questions, including whether distinctions based on gender identity held the same weight as dividing participation based on race or religion, to which Viksnins responded by stating biological differences between sexes necessitated distinct categories for competition.

Throughout the hearing, both proponents and opponents of Cooper’s cause filled the courtroom, indicating the far-reaching impact of this case beyond the immediate legal sphere. Numerous friend-of-the-court briefs were filed by organizations and individual athletes supporting either side, illustrating the contentious nature of transgender participation across sports nationwide.

Coupled with the rising discourse surrounding transgender rights, especially since the last fall elections where this issue found itself emphasized strongly by political figures, the court’s ruling is poised to have reverberations for other states facing similar legal quandaries.

Senator Erin Maye Quade from Minnesota voiced the hopes of many advocates, reinforcing the notion of Minnesota as a refuge state for transgender individuals, emphasizing the importance of allowing everyone the liberty to pursue their passions free from discrimination.”

"This case is not just about JayCee; it symbolizes larger societal movements toward acceptance," said Maye Quade. “We want to showcase Minnesota as a leader and advocate for justice.”

Yet, the contrasting argument emerged from underpinning concerns about competitive equity, which has led to regulations governing transgender athletes across various sports. At least twenty-four states have enacted similar restrictions, making competitive participation by transgender females increasingly complicated.

The judge's inquiry circled back to whether any legitimate business reason existed for excluding Cooper from the female category, inferring possible biases were reinforcing exclusions contrary to the act’s intention.

The conclusions drawn from the Minnesota Supreme Court's deliberations will not only address the Cooper vs. USA Powerlifting dispute but potentially influence broader legislative discussions across various states dealing with transgender rights in athletics. The court has yet to determine the timeline for their ruling, but the legal community awaits its outcome, which will be pivotal for the future of transgender athletes nationwide.
