Lula Administration Set To Release FGTS Funds For Laid-Off Workers

The government aims to unblock funds for those who opted for annual anniversary withdrawals, addressing widespread financial difficulties.

The Lula administration is preparing to implement significant changes to the Fundo de Garantia do Tempo de Serviço (FGTS), announcing the release of funds for workers who opted for the anniversary withdrawal model and have since faced job termination. This measure, anticipated to be formalized shortly, aims to support over nine million workers who have been unable to access their FGTS balances due to the restrictions imposed by the anniversary withdrawal option.

Currently, the anniversary withdrawal model, instituted during former President Jair Bolsonaro’s administration, permits workers to access a portion of their FGTS annually, but prohibits full access to the remaining balance upon dismissal without cause. Rather, affected workers are restricted from retrieving their funds for two years after losing their jobs, only being able to claim the 40% termination penalty from the employer.

President Luiz Inácio Lula da Silva's administration is responding to mounting pressures from labor unions and advocates who assert the necessity of providing access to these funds, especially as many were previously uninformed about the limitations of their withdrawal choices. According to reports, the measure is likely to benefit only those workers who were laid off prior to the announcement, as future terminations may still be bound by the same restrictions.

Sérgio Nobre, the national president of CUT (Central Única dos Trabalhadores), supports the new initiative, stating, "Sacar o FGTS é um direito do trabalhador, que pode usar esse dinheiro para pagar suas contas, fazer compras, consumir e, dessa forma, se injeta mais dinheiro na economia." (Withdrawing FGTS is a worker's right, which they can use to pay their bills, shop, consume, and thereby inject more money backinto the economy). The affirmation highlights the significant role these funds could play in injecting liquidity back to the consumer market, especially amid economic strains.

Minister of Labor Luiz Marinho has expressed intentions to discontinue the anniversary withdrawal model since taking office, citing its detrimental effects on workers and their access to safety net funds during employment disruptions. The proposed measure may signal a pivoting strategy by the Lula government not only to relieve immediate financial barriers for unemployed workers but also to fundamentally reassess the future viability of the anniversary withdrawal option.
