Three weeks after President Donald Trump inaugurated the Department of Government Efficiency (DOGE), legal challenges erupted from various organizations questioning its establishment and operations. Still, its inception sparked immediate pushback, leading to multiple lawsuits focusing on regulatory compliance and transparency.

Establishing DOGE is part of Trump’s broader agenda to reduce waste and inefficiency within the federal government. The White House announced the department's formation through an executive order, asserting its purpose was to oversee the modernization of IT systems and improve government productivity. Billionaire Elon Musk was appointed to lead DOGE, with significant influence over government software modernization efforts. Yet the mission appears to be more than just streamlining; it touches on cutting costs.

Despite this ambitious vision, concerns arose as several advocacy groups filed lawsuits against the administration, citing lack of oversight and potential conflicts of interest. The American Public Health Association, the American Federation of Teachers, and Citizens for Responsibility and Ethics raised alarms about DOGE's operations, describing it as 'a shadow operation led by unelected billionaires' with issues of transparency.

One lawsuit emphasized, 'DOGE is slated to dictate federal policy… under a shroud of secrecy with none of the transparency, oversight, or opportunity for public participation the law requires.' Legal experts have highlighted how such claims undercut the established legality of departments created with little congressional oversight.

According to the Federal Advisory Committee Act (FACA), advisory committees must maintain fair balance and transparency, which critics argue DOGE violates. This act was established to guarantee public awareness and impartiality among the advisory members of government panels. While the executive order proposed to absorb the existing United States Digital Services and transition it to the United States DOGE Service, it failed to explicitly address the budget-cutting intent long associated with the efficiency-driven initiatives. Many critics suggest this omission is strategic as the administration faces lawsuits demanding clarity and accountability for fiscal decisions affecting numerous public services.

Elon Musk’s engagement with the new department has drawn significant media attention, particularly as he has invested heavily in Trump's presidential campaign. His role has raised questions about the tightly knit relationship between public policy and private interests. Musk has publicly stated his commitment to not drawing any salary for his involvement with DOGE, but this has not assuaged fears about potential biases favoring business priorities over public welfare.

Trump’s approach to government efficiency has gained bipartisan support, with some lawmakers acknowledging the importance of reducing redundancy and wasteful expenditure. Nonetheless, as faith in governmental institutions wanes, so does the public's trust. Critics argue efficiency should not translate to austerity measures. Vivek Ramaswamy, initially expected to co-lead DOGE alongside Musk, signaled his departure to run for governor of Ohio. Nonetheless, during his tenure, Ramaswamy and Musk argued for cutting the federal bureaucracy, framing it as necessary for financial solvency.
