Justice Department Sues Alabama Over Voter Roll Purge

Federal lawsuit targets Alabama's effort to remove voters close to election date amid rising concerns for voting rights

The Justice Department has filed a notable lawsuit against Alabama and its Secretary of State, Wes Allen, focusing on the state's recent efforts to purge voter rolls. This legal action on September 27 accuses Alabama of initiating this voter removal too close to the upcoming November 5 election, alleged to be against federal regulations.

At the heart of the lawsuit is the National Voter Registration Act's stipulation, which mandates states to avoid purging voter registrations within 90 days prior to an election. The complaint voiced by the Justice Department highlights Alabama's actions took place merely 84 days before the election, creating legal grounds for the suit.

Wes Allen’s office previously announced their campaign against noncitizen voters, claiming over 3,500 individuals registered to vote were being targeted for removal based on noncitizen identification numbers assigned by the Department of Homeland Security. This announcement raised eyebrows, as it did not clarify when these ID numbers were issued, leading to concerns about the timing of such directives.

According to the Justice Department, the approach taken by Alabama officials may unintentionally affect eligible voters, including naturalized citizens who hold such identification numbers. Kristen Clarke, Assistant Attorney General for the DOJ’s Civil Rights Division, emphasized the urgency of stopping voter confusion and ensuring fair access to the ballot box as election day draws near.

“The right to vote is one of the most sacred rights in our democracy,” Clarke stated. “Officials across the country should heed the National Voter Registration Act’s clear restrictions on systematic list maintenance efforts within 90 days of elections.”

While the Justice Department is pushing for immediate legal remedies, including reinstatement of voter rights for those affected and notification for those unjustly purged, Allen continues to maintain his actions align with his responsibility to the state's electoral process. He stressed the importance of ensuring only American citizens participate, stating, “I was elected secretary of state by the people of Alabama, and it is my constitutional duty to…”

This legal battle adds to growing tensions surrounding voting rights and restrictions as many states grapple with defining eligibility for the election rolls. Civil rights organizations have also stepped forward, echoing alarm over this voter purge initiative, arguing it risks disenfranchising legitimate voters, especially among newly naturalized Americans.
