Italy Fines OpenAI €15 Million Over ChatGPT Privacy Breaches

The Italian data agency finds OpenAI violated privacy laws, triggering concerns over AI data usage.

Italy's data protection authority has fined OpenAI, the maker of ChatGPT, €15 million ($15.58 million) after concluding its investigation concerning the use of personal data by the AI application. This significant penalty is the result of the Garante’s thorough examination of OpenAI's data practices, highlighting issues with processing personal data without sufficient legal justification and failing to uphold transparency standards for users.

The Garante, renowned for its proactive oversight of AI compliance with European Union data protection norms, found OpenAI's practices lacking. According to the authority, the company processed users' personal data to train ChatGPT without proper consent. "They violated the principle of transparency and the related information obligations toward users," said the Garante, indicating serious concerns about how the AI operates with regard to user data.

The fine is particularly noteworthy considering the Garante's critique of OpenAI's safeguards for protecting children's data. The investigation deemed the existing age verification system insufficient, effectively exposing users under 13 to potential harm from inappropriate content generated by the AI.
