High Court Modifies Sentence For Handwara Rape Case

Justice system review sparks debate on public safety and response to sexual violence

Srinagar-The High Court of Jammu & Kashmir and Ladakh has made significant modifications to the sentencing of four individuals convicted for their involvement in the tragic rape and murder of a 14-year-old girl from Handwara, situated in Kupwara district, back in 2007.

The case has echoed through the courts since the Principial District & Session’s Judge Kupwara pronounced the death penalty on these four men — Mohammad Sadiq Mir, also known as Sada, Jehangir Ansari from Nawada Jungoo area of West Bengal, Azhar Ahmad Mir, colloquially called Billa, and Suresh Kumar Sasi, known as Mouchi, who hails from Rajasthan but is currently residing in Amritsar, Punjab. This verdict came after they were found guilty of the horrific crimes against the minor.

Recently, the division bench, which included Justice Sanjeev Kumar and Justice M.A. Chowdhary, explained their reasoning for such drastic changes. “We are inclined to modify the sentence of death imposed by the trial Court on the appellants for commission of offence punishable under Section 302 RPC and instead sentence the appellants to imprisonment for life without remission for at least 25 years,” the court stated. This means the convicts cannot be released before serving at least 25 years behind bars.

Alongside the life sentence, the High Court ordered the continuation of other sentences imposed by the trial court, ensuring the duration of imprisonment would run concurrently. The court clarified, “the trial court should issue warrant for execution of sentences, as per this judgment.” This was seen as one stride toward justice for the victim who suffered immensely.
