Former Oath Keeper Receives Probation For January 6 Role

Brian Ulrich, who aided Capitol riot prosecutions, spared from prison after guilty plea for seditious conspiracy

A former member of the anti-government group Oath Keepers, Brian Ulrich, has been sentenced to probation for his involvement in the January 6, 2021, Capitol insurrection — marking both the gravity and the complexity of the legal aftermath of the event. This Georgia native personally played a key role before, during, and after the riot, yet his cooperation with federal prosecutors significantly influenced the leniency of his sentencing.

On Tuesday, U.S. District Judge Amit Mehta sentenced Ulrich to three years of probation, six months of home detention, and 120 hours of community service, along with ordering him to pay $2,000 as part of his restitution for the chaos caused during the Capitol riot. During the sentencing, Judge Mehta noted the importance of Ulrich's decision to assist the government, implying he deserved "a debt of gratitude" for accepting his responsibility and helping the nation heal.

Ulrich’s troubles with the law began when he, alongside other Oath Keepers, plotted to stop the certification of the 2020 presidential election results. The group, under the leadership of Stewart Rhodes, engaged in encrypted chats voicing their intent to use any necessary means, including violence, to quash the certification process. Ulrich's own words included statements indicating he would not shy away from civil conflict if deemed needed: "And if there's a Civil War then there's a Civil War," he once quipped to his fellow members.

At his core, Ulrich pled guilty to seditious conspiracy, the most significant charge arising from the Capitol riot. By cooperating with prosecutors and testifying against other members of the Oath Keepers, he positioned himself as perhaps one of the most influential witnesses related to the domestic terrorism of January 6. Notably, Ulrich was the first individual sentenced after pleading guilty to seditious conspiracy within this complex web of prosecutions stemming from the Capitol attack.

The details of Ulrich's actions on January 6 paint a vivid picture. Prior to the insurrection, he had taken seemingly innocuous steps of preparation.
