On October 2023, the nightmare began when Jason Pass shot and killed two of his neighbors, Marie Delille's husband and adult son, outside their apartment at Flatbush Gardens, New York. This double homicide erupted over longstanding disputes, primarily revolving around noise complaints. According to the family’s lawsuit against the building’s owners, they were already aware Pass posed a security threat yet took no action to address it.

Marie Delille recounted the horrifying moment she witnessed the violence unravel. Dodging bullets, she attempted to pull her loved ones away from Pass, all the meanwhile calling 911 for help. “That man [was] killing my family point blank,” lamented Delille, alleging the apartment management ignored her repeated warnings about Pass's harassment.

The lawsuit, seeking $10 million, was filed last month by Delille in Brooklyn Supreme Court. Adam Konta, her attorney, expressed hope this case would serve as a landmark decision, reinforcing landlords' obligations to provide safe living environments. “I think landlords have been able to hide behind the inaction of people under these circumstances in the past,” Konta stated. “But the reality is they have a duty.”

Clipper Management, the property management company, responded to the tragedy by stating their commitment to the safety of residents but refrained from commenting on the lawsuit. The apartment complex, known as Flatbush Gardens, has suffered from 4,000 active code violations at the time of the shooting. Despite past efforts to secure tax breaks for addressing infrastructural issues, residents complained of unsafe conditions.

The alarming realities of apartment safety came to light during the shooting incident, which had been caught on surveillance footage and circulated widely on social media. Pass had previously been arrested for menacing and reckless endangerment. After fatally shooting Delille’s husband and son, Pass himself was shot by police just days later after brandishing a knife during confrontation.

Meanwhile, across the nation in Charleston, South Carolina, legal proceedings were simultaneously underway concerning another fatal incident. Aric Hutchinson, the husband of Samantha Miller, who tragically died on her wedding day, has initiated legal action against Jamie Komoroski, the driver convicted for DUI who has since been sentenced to 25 years imprisonment for her actions.

Hutchinson is also suing Folly Tacqueria LLC, the establishment accused of overserving Komoroski leading up to the fatal crash. According to court documents, Hutchinson's legal team has faced challenges securing Komoroski’s deposition for the civil suit, with multiple rescheduling attempts failing due to various reasons.

The timeline of Hutchinson’s efforts presents the complexity of advancing legal action. Starting from August 2024, his attorneys proposed dates for deposition, only to receive continual postponements and evasions from Komoroski's legal representatives. Hutchinson's lawyers have expressed frustration, contending Komoroski's lack of cooperation has impeded their case progression. “Her failure to sit for deposition has caused delays and hampered our ability to litigate,” claimed Hutchinson’s legal team.
