Elon Musk's recent online interview with German far-right leader Alice Weidel on the platform X has prompted intense scrutiny from European regulators concerned about potential violations of EU law. The event, held on Thursday night—a strategic move just weeks before Germany's general election on February 23—saw Musk engaging with Weidel, who is the leader of the Alternative for Germany (AfD) party, currently polling second among candidates.

This unprecedented meeting has drawn attention not merely for its content, but for the massive platform Musk has provided to Weidel, who has been vocal about her party's anti-immigration stance. Observers have pointed out Musk's previous endorsements of the AfD, with the tech billionaire recently labeling them as "the last spark of hope" for the nation. This comment has raised eyebrows and accusations of direct interference in the German electoral process.

According to the online news portal Politico, as many as 150 officials from the EU Commission will monitor the livestream across Europe on the night of the interview. Their mandate is to examine whether Musk may potentially skew his social media platform's algorithm to favor Weidel’s visibility and outreach over her rivals, which would contravene established EU tech regulations.

The central concern lies not just with the dialogue's ideological content but with the underlying question: Is Musk giving Weidel and the AfD an unearned advantage by manipulating the platform’s algorithm? There are allegations claiming Musk could direct X to prioritize his posts and interview content over others, which would unfairly influence the electoral battlefield. Historian Matthias Kettemann stated, "Musk cannot be forbidden from conducting such conversations. He owns a powerful communications platform and is not bound by traditional media laws."

Weidel's appearance on Musk's platform is particularly significant, considering the AfD's growing prominence and the high stakes of the upcoming election. During their conversation, Weidel took the opportunity to criticize former Chancellor Angela Merkel, who she claims ruined the country’s economy by switching to green policies. Musk appeared to endorse her views, echoing sentiments about energy policy being overly complicated and suffering from bureaucratic red tape.

Interestingly, much of the interview revolved around contention points like energy policy, where Musk stated, "Atomic energy is fantastic," aligning with Weidel's calls for its increased use. Both participants expressed frustration over bureaucratic inefficiencies impacting businesses and innovation within Germany. Government officials back home, such as German Economy Minister Robert Habeck, voiced their unease over the ramifications this may have on the elections. He highlighted the need for transparency about how X operates its algorithms, emphasizing, “Whether this system favors views from the AfD or Musk himself, is currently difficult to distinguish.”

The Bundestagsverwaltung has launched investigations to determine if Musk's actions amount to illegal party donations, particularly as Musk's platform typically charges for such visibility. A spokesperson for Bundestagsverwaltung confirmed, “We are currently clarifying the circumstances.” Meanwhile, organizations like Lobby Control have raised alarms about potential illegal election financing due to Musk's apparent use of X to boost Weidel’s profile without reaching similar followings from other candidates.

Despite the concern from various quarters, Musk remains undeterred and showed no signs of backing down from his support of Weidel. He reiterated what seemed to be his campaign message for the AfD, stating, “People want change, and if they want change, they should vote AfD.” This prompted speculation about whether this partnership serves as more than just political alignment and ventures closer to outright electoral interference.

Moving forward, EU regulators seem poised to act. They wield significant means to impose penalties on Musk, should any irregularities be observed; this includes facilitating inquiries to analyze the algorithm used during the livestream and its possible exploitation. The potential consequences could see Musk fined up to six percent of X’s global annual revenue if deemed guilty of violating EU laws.

With the election fast approaching, the discourse will only heat up as officials weigh the balance between freedom of expression and regulatory compliance.
