Daikin Expansion Plan Faces Legal Setbacks Again

Court rules against local opposition, allowing factory upgrades to proceed amid concerns over emissions.

Legal tensions surrounding the expansion of the Daikin factory at Oullins-Pierre-Bénite have reached another pivotal moment as the Administrative Court of Lyon recently rejected requests from local opposition groups aiming to halt the project. This decision, delivered on January 23, 2024, marked the latest chapter in what has become an intensifying dispute over environmental concerns, particularly emissions related to harmful pollutants.

The Daikin Chemical France expansion initiative, first proposed back in 2021, includes the establishment of new chemical production and storage units. The project has been fraught with challenges, especially from local associations like Bien vivre à Pierre Bénite and Générations futures, who have focused on the impact of potential emissions on both the environment and community health.

Initially, the project's authorization by the Rhône prefecture was granted, only to be contested legally. The court noted, "Les juges des référés constatent que le projet d’installation de pré-compound comprend désormais, en plus du dépoussiéreur déjà mis en place, un pré-filtre et une unité de filtration absolue, par des filtres HEPA 14 de très haute efficacité," emphasizing the upgrades made.

With the updated application, Daikin stated its commitment to advancing cleaner operations at the factory. The recently announced court decision has been met with mixed reactions. While the ruling highlighted the importance of capturing progress made by Daikin, it also necessitated the acknowledgment of historical concerns about pollution and community impacts.

Despite these improvements, opposition groups expressed disappointment with the ruling, which stated, “Une telle étude n’était pas requise, contrairement à ce que prétendaient les requérants.” The judges elaborated on their decision, asserting there weren't notable impacts on the environment or human health from the modified proposal, effectively dismissing the need for the extensive impact study initially deemed necessary.
