In a significant ruling, the Criminal Chamber of First Instance at the Court of Appeal in Tangier sentenced a border guard and an auxiliary forces member to one year in prison for their roles in a case involving illegal immigration and drug smuggling. The verdict, issued on March 23, 2025, followed a series of investigations that revealed a complex operation aimed at facilitating the escape of a wanted individual out of Morocco.

The case dates back to September 2024, when a patrol from the border guard in the Tahaddart area successfully intercepted an attempt at illegal immigration. Using a 'Jet Ski', the patrolling officers halted a group attempting to flee the country while in possession of a substantial amount of 'hashish'. This operation set off a chain of investigations leading to the subsequent arrests of several individuals involved.

According to court documents, the two primary defendants were implicated in a plan to assist a man named Zakaria Z., who had an outstanding national warrant for his arrest, in leaving Morocco through illicit means to evade law enforcement. Evidence presented during the trial indicated that the suspects coordinated their efforts with a woman named Safaa, who is believed to have connections to networks specializing in illegal immigration and drug trafficking.

The court sessions unveiled troubling details about the operation's orchestration. Calls intercepted revealed agreements to use the Jet Ski not only for transporting Zakaria Z. but also to smuggle the aforementioned stash of hashish. The defense argued that the military officer and the auxiliary forces member were not on duty during the incident and thus could not be held fully responsible for the actions taken.

Investigation results indicated that the border guard allegedly accepted 4 million centimes (roughly 40,000 dirhams), while the auxiliary forces member received 5000 dirhams for their roles in facilitating the escape. During the trial, defense attorneys pushed back against the charges, positing that their clients had been misled and not entirely in control of their actions at the time of the incident.
