Corruption Allegations Shake Amazonas Judiciary

Eletrobras accuses judges of fraud amid investigations of mismanagement and judicial misconduct.

The judiciary system of Amazonas is under intense scrutiny amid allegations of corruption and fraudulent activities surrounding Eletrobras, one of Brazil’s largest electricity providers. The company has described recent legal maneuvers as "a true daylight robbery" as they navigate through the troubling waters of judicial proceedings which have temporarily blocked over R$ 1 billion from their accounts. Eletrobras accuses judges of collusion with individuals seeking to claim R$ 150 million linked to outdated financial credits—claims they boldly contest as fraudulent.

Central to the investigation are Judge Jean Pimentel and Desembargador Elci Simões, who have faced suspension by the corregedor national de Justiça, Mauro Campbell Marques, after concerns of misconduct emerged. These actions were precipitated by legal motions initiated by Bruno Eduardo Thomé de Souza, who alleges entitlement to credits dating back to 1966. According to reports from ATUAL MANAUS, Eletrobras claims to have evidence pointing to fraudulent actions by these individuals.

Earlier processes initiated by Thomé shifted between federal and state courts, leading to complications due to differing opinions on jurisdiction. A key moment occurred when the Tribunal Regional Federal da 1ª Região (TRF1) ruled against the federal jurisdiction being competent for the case last November, declaring the matter should return to the Comarca de Presidente Figueiredo.

Patently unsettling was the rapid succession of legal decisions following the TRF1 ruling. On February 3, Pimentel ordered the blocking of nearly R$ 149 million from Eletrobras’ accounts, citing Thomé’s demands. This heavy handedness led to severe financial repercussions for Eletrobras, whose accounts were overblocked due to multiple concurrent orders from various banks—resulting in significant liquidity issues.

The matter escalated when, on February 9, Thomé challenged Eletrobras’s stance and sought immediate release of the blocked funds. Within hours, Pimentel had complied, issuing orders for the release of the funds in rapid succession. Eletrobras's management responded with outrage, underscoring the judicial decisions as nonsensical and indicative of deep-rooted corruption, which they characterized as "a real daylight robbery."

February 11 marked another turbulent day as the tables turned. Pimentel issued another order, nullifying the release of funds following Eletrobras’ emergency petition to Desembargador Simões. Jomar Fernandes, the president of the Tribunal de Justiça do Amazonas, later expressed concerns about the integrity of such judicial decisions, demanding heightened caution and emphasizing the necessity for serious evaluations going forward. “The moment requires caution and serenity, allowing investigations to follow due course,” he declared.

Through these tumultuous events, Judge Jean Pimentel defended his judicial conduct, stating all funds had been returned to the judicial account even before any superior court intervention. He reiterated the accountability of Eletrobras for its financial obligations spanning many years and highlighted the complexity of the case as being addressed within the legal framework.

Pimentel's rebuttal includes mention of past diligence from the judiciary when handling contested actions and the authenticity of financial instruments claimed by Thomé. Yet, with mistrust overshadowing these proceedings, the case has drawn ire from multiple stakeholders, leading to overarching calls for full transparency and adherence to ethical standards.

On February 14, Elci Simões suspended himself from the case amid these rising tensions, as suspicions mounted about the legitimacy of the processes at play. The national corregedoria acted swiftly, detaining both Simões and Pimentel from judicial duties, allowing law enforcement to conduct extensive investigations unhindered.
