Elaina Jennings, 25, and her 32-year-old boyfriend Daniel Giacchina now face charges of murder and first-degree child abuse. The allegations stem from evidence showing Giovanny had been restrained, often confined to a corner of his bedroom, beaten, and subjected to terrible punishment. His tragic death has been categorized by authorities as murder as he succumbed to injuries including blunt force trauma and complications from extreme confinement.

It was on the afternoon of July 30 when Jennings called the authorities, stating her son was not breathing. Upon arrival, first responders found the unresponsive boy at their mobile home. He was pronounced dead shortly after, with numerous injuries indicating abuse. The Oakland County Prosecutor's Office detailed the unthinkable extent of the boy's suffering during subsequent press conferences.

Prosecutor Karen McDonald described the home environment as infested with violence and malice, saying, "Chulo was confined, beaten, and bound to the wall using a staple gun. He was badly injured, but he was not taken for medical treatment because his mother knew it would reveal the abuse." This chilling statement indicates the depth of neglect and violence he faced leading up to his tragic demise.

Medical examination results revealed the severity of Giovanny’s condition. An autopsy confirmed he had died from blunt force trauma to his abdomen and had suffered significant injuries over his small frame, including extensive bruising and lacerations. McDonald provided graphic details, stating, "Chulo had pervasive bruising to his abdomen, which was also bloated and distended. He had visible injuries all over his body, and even evidence of being shot with a BB gun." Such revelations astound the public, prompting questions on how this went unnoticed.

The extent of the abuse was compounded by the couple's efforts to conceal their actions. It is alleged they even went so far as to plot to mislead officers — claiming Giovanny had been with his biological father during the fatal incident. This effort was short-lived as the police quickly discovered no truth to this, realizing they were being misled by Jennings.

Witnesses, including the boy’s 4-year-old brother, described instances of violence. He reported observing Giacchina shoot Giovanny with the BB gun and spoke of the extreme discipline imposed by both adults. Prosecutors emphasized, "The 4-year-old explained Chulo was often locked away or beaten, confirming he was regularly terrorized by Giacchina, who cared for him and other children during the day when Jennings was away at work."

Details emerged about the contemptible living conditions Giavanni endured under the couple's watch. He was reportedly kept confined inside what has been described as "a pen" measuring just 11 by 36 inches, where he lay on hard wooden slats separated by black curtains to block any view of the outside. This dehumanizing treatment deeply horrified investigators.

During the investigation, McDonald revealed evidence of Giacchina's attempts at cruel physical punishment, including staples being used to bind Giovanny to the wall, making it impossible for him to turn away. McDonald stated, "He texted Jennings about his method of confinement, laughing as they conspired to keep Chulo facing the wall as punishment for simply trying to look out the window." A photo of this despicable act exists, showcasing the extreme degradation to which he was subjected.

The couple’s attempts to cover up their crimes only painted them as more culpable. They were charged previously with lying to law enforcement before murder and child abuse charges were laid following extensive investigations, which included spending over 100 hours reviewing deeply disturbing videos and photos. The thorough investigation included scrutinizing their social media accounts and seizing evidence from their residence.

McDonald noted: "Every child deserves safety and security, not terror and abuse. This case has raised critical questions about how such abuse could happen and go unnoticed for so long. Parents are agents of protection, not perpetrators of violence. Our primary goal now is to seek justice for Chulo and his family."

Both Jennings and Giacchina have been denied bail and are currently held at the Oakland County Jail as they await their next court appearances. Their arraignment occurred on August 9, and another hearing is set for August 21, where the court will review the evidence against them and determine the next steps.
