When Marcus Johnson, 34, from Cwmbran, Torfaen, bought his first car—a Suzuki Swift—in 2017, he was completely unaware of the 25% commission hidden within his finance agreement. “I signed a few documents and then drove away in the car,” he recounted, expressing his shock when he learned the dealership received £1,650 as part of the deal. This kind of lack of disclosure has raised serious questions concerning consumer rights and informed consent.

The Financial Conduct Authority (FCA) is currently consulting on extending the response time dealers have to address complaints about these hidden commissions. The aim is to manage the anticipated surge of claims as the public becomes more aware of their rights. According to legal experts, this could create delays for the rightful compensation these mis-sold deals warrant.

Looking at the scale of the issue, around two million cars are financed this way each year, and the FCA has recognized the potential for billions of pounds to be involved. A decision made by the Court of Appeal last month expanded the range of eligible claimants, reiteratively emphasizing the need for customers to be informed about any commission payments involved prior to agreeing to any terms.

This ruling is particularly important as it transcends the specific arrangements banned by the FCA back in 2021. The appeal judges unanimously determined it illegal for finance companies and dealers to pocket commissions without securing clear and explicit consent from consumers. The terms and agreements often contain complex legal jargon buried deep within small print, which the judges noted is insufficient for proper consent.

Through the hearing, Marcus Johnson’s case emerged as the touchstone example. He initially faced the burden of unexpected payments on top of the car's purchase price, reflecting the experiences of countless buyers who have found themselves unknowingly overpaying due to undisclosed commissions. “For someone like me, who couldn’t afford to buy the car outright, encountering this kind of financial dressing was heartbreaking,” he stated, highlighting the distress consumers like him often endure.

He advises individuals affected by hidden commissions to log claims as early as possible, emphasizing the importance of determining whether their financing agreements included discretionary commission arrangements. “You don’t need to go through claims management firms, which often take hefty cuts from any found payouts,” he added, stressing the need for independent claims.

Legal experts stress the necessity for victims to investigate their contracts closely, pointing out the differing impacts of clear versus buried disclosures on any potential claims. Claims stemming from undisclosed contracts may hold stronger cases than those where the fine print was at least acknowledged yet not made prominent.

Given the recent developments, it raises the question: how long will it take before affected motorists see any compensation? With banks expected to lodge appeals to the Supreme Court, there may still be significant delays before compensation structures are finalized. Many dealerships have already pressed pause on new finance agreements as they await the fallout from this ruling.

Johnson himself noted, “For me, the excitement of winning my case is clouded by the uncertainty of what this means for other, equally deserving, families.” His sentiment epitomizes the hope and frustration felt across the community of mis-sold finance agreement consumers.
