California Stands Firm Against Trump Over EV Tax Credit

Governor Gavin Newsom vows to revive state EV rebate program if federal incentives are cut, prompting sharp responses from Elon Musk

California is bracing itself for what could be a monumental clash as Governor Gavin Newsom promises to reinstate the state’s electric vehicle (EV) rebate program if President-elect Donald Trump eliminates the federal zero-emission vehicles (ZEV) tax credit. This tax credit, which currently stands at $7,500, has been pivotal in making electric vehicles more financially accessible to the average consumer.

Governor Newsom's declaration this week has sparked considerable backlash from Tesla CEO Elon Musk, who fears the potential exclusion of Tesla from the reintroduced program might endanger the company’s competitive edge. Musk, who has garnered attention for his close ties with Trump, expressed his disapproval, characterizing such moves as "insane."

During Trump's campaign, he frequently labeled President Joe Biden's initiatives as mandates, particularly targeting the EV policies included within the Inflation Reduction Act (IRA). Although no EV mandate exists at the national level, the IRA introduced significant incentives for zero-emission vehicle adoption, which could be at risk under Trump’s administration. Musk, also supportive of ending the tax credits, has suggested this would fortuitously benefit Tesla, claiming it has garnered enough market position to withstand any downturn.

Currently, Tesla holds nearly half of the market share for electric vehicles sold within the United States, far outpacing competitors like General Motors and Ford. Analysts argue this could potentially put Musk and Newsom on opposing sides of the increasingly volatile political spectrum, especially as Musk’s influence within the Trump administration grows.

Newsom has publicly affirmed California’s commitment to clean transportation, stating, "We’re not turning back on a clean transportation future — we’re going to make it more affordable for people to drive vehicles." His approach indicates readiness to maneuver around Washington's decisions to sustain California as the largest EV market in the country.

California’s EV market has seen explosive growth, with the state achieving about 2.1 million sales of zero-emission vehicles by the end of the third quarter of this year. Recognizing this demand, Newsom is poised to re-establish the state's Clean Vehicle Rebate Program, which had been discontinued last year. The Governor emphasizes consumer choice for EVs as opposed to imposing mandates, reflecting significant public interest as one-quarter of new car purchases projected to be zero-emission vehicles.

Complicatively, though, Newsom’s proposal may include mechanisms aimed at fostering competition, which might result in Philadelphia Tesla being permanently excluded from future rebates. This has raised eyebrows among industry observers, questioning the long-term impact such exclusions could have on the industry and the state.

Musk's open criticism—"Tesla is the only company who manufactures their EVs in California!"—underscores the stakes involved. He suggested if Tesla were left out of rebate eligibility, it could prompt the company to shift its production operations out of state, hurting California's economic and employment landscapes. This potential shift seems to parallel Musk's historical trend of relocating significant operations from California to Texas.

Despite Musk's warnings, Newsom’s administration remains firm, stating, "We will intervene if the Trump Administration eliminates the federal tax credit, doubling down on our commitment to clean air and green jobs." This commitment reflects California’s broader strategy of leading the charge for clean energy, even as they cast wary glances at the upcoming administration.

Meanwhile, three of the largest automakers—Ford, Stellantis, and General Motors—are advocating for the preservation of the federal EV tax credit, rallying other companies to support their cause. Together, they have penned letters to the Trump administration seeking assurance of "stability and predictability" around emissions standards and subsidies.

On the flip side, analysts remain divided on the potential fallout from Newsom's proposed tax credits and the political maneuverings of Musk. Dan Ives, a senior analyst at Wedbush, characterized the situation as reminiscent of the titanic conflicts seen on-screen—referencing Game of Thrones. He elaborated, saying, "This is clearly a political move of Newsom versus Musk, as Musk has now sat within the cabinet, co-leading commissions with Trump focused on federal budget cuts and other key issues. The possible shift from California could invite Tesla to double down on its presence elsewhere."

At this juncture, the air is thick with tension as Newsom's commitment to clean energy collides with Musk’s commercial ambitions and his influence within federal politics begins to take shape. Both figures seem poised for what could be the next significant showdown over the future of electric vehicles and sustainability initiatives, not just within California, but across the nation as well.

Newsom’s rallying call for EV equity signifies California's unwavering commitment to climate action, prodding the rest of the country to evaluate its own stances on renewable energy and sustainability policies. Yet, as these developments play out, the stakes are high, and the decisions made will likely mold the state’s environmental future as well as the broader automobile industry.
