One prominent voice questioning the government’s oversight was Liberal Senator James Paterson. He probed whether the historic NZYQ High Court ruling, which deemed indefinite detention illegal, could apply to this detained individual. Home Affairs Secretary Stephanie Foster's response was measured, indicating the need for more information before making such determinations.

Further complicity arose when Home Affairs Minister Tony Burke faced scrutiny over visa processes prior to this incident, with accusations from the Coalition asserting the government was “lax” toward security checks involving new Palestinian arrivals.
