Apple Inc. faces serious legal challenges after the tech giant dropped its plan to scan iCloud for child sexual abuse material (CSAM). A significant lawsuit has emerged, led by a 27-year-old woman who alleges she was sexually abused as a child and states Apple has failed to protect individuals like her from the circulation of abusive material.
The woman, who is remaining anonymous due to the sensitive nature of the case, claims Apple abandoned its previously proposed plan to detect CSAM after strong opposition from privacy advocates and child safety organizations. This abandonment, she argues, has allowed sexual abuse materials to proliferate on the platform.
Initially, back in late 2021, Apple announced its intent to introduce scanning technology to identify CSAM. This innovative approach was set to use on-device hashing to detect abusive images automatically, alerting users if they were about to send or receive such material. The scans would include software warnings for those using the nudity-detection features aimed at protecting children during interactions on platforms like iMessage.
Despite the initial promise, the CSAM detection feature was scrapped by Apple by the end of 2022, which drew ire from many child protection advocates. Concerns about privacy and the potential for increased government surveillance led to vocal outcry and eventually deterred Apple from deploying the CSAM scanning technology.
Now, the woman alleges Apple has effectively breached its promise to safeguard victims, asserting it allows the very material she seeks to prevent from being shared. Alongside this case, another lawsuit was filed by the family of a nine-year-old victim of CSAM, emphasizing Apple’s alleged negligence. The girl’s case details how online predators exploited iCloud to share inappropriate materials with her, pressuring her to create and share similar content.
Apple has typically defended itself under Section 230 of federal law, claiming immunity from liability for user-generated content uploaded to their platform. They argue iCloud is not a product by itself and should not face certain product liability claims. But, recent court rulings may challenge this conventional defense, particularly as they relate to active moderation.
