Kari Morrissey, the special prosecutor assigned to the case, filed court documents recently challenging Judge Mary Marlowe Sommer’s decision to completely dismiss the charges against Baldwin. The judge had ruled on July 12, 2024, asserting Baldwin’s legal team was prejudiced by the prosecution’s failure to disclose certain pieces of evidence during the trial.

During the trial, significant evidence emerged: live rounds of ammunition supposedly found on the set of "Rust." This evidence was revealed dramatically when the judge herself opened an evidence envelope during court, pointing out bullets matching the live ammo allegedly present at the scene of the tragic shooting. This courtroom scene took many by surprise, leading to Judge Sommer's harsh criticism of the prosecution.

“If this conduct does not rise to the level of bad faith, it certainly shows signs of scorching,” said Judge Sommer, expressing her frustration with how the prosecution handled the case. The ruling effectively dismissed the charges against Baldwin with prejudice, meaning they could not be prosecuted again without new developments.

Now, Morrissey is seeking to challenge this ruling, arguing it was the defense’s strategy to confuse the judge about the relevance of the suppressed evidence. She insists the team had prior knowledge of the bullets and suggests there was no genuine surprise on their part when the live ammunition was disclosed.

According to Morrissey, the defense team sprang this motion to dismiss during the trial, taking advantage of the prosecution's limited resources and timing. She has formally requested the judge to reconsider her decision and is pushing for the defense to disclose how and when they became aware of the bullets.

"The fact the motion was raised during trial was tactical on the part of the defense to gain the upper hand," Morrissey stated, arguing Baldwin’s team was not hampered by any failure on the prosecution’s part.

Despite the significant evidence introduced, Morrissey reiterates her belief the bullets were irrelevant to Baldwin's defense. She claims the prosecution had no obligation to disclose them as they were not exculpatory. This raises the question of whether Baldwin's defense should have known to safeguard their strategy regardless of the prosecution's actions.

For those following this case, the details surrounding the shooting have been tragic and shocking. Cinematographer Halyna Hutchins was fatally shot on set during the filming of "Rust." Baldwin, who was rehearsing with what he believed to be a safe prop gun, was initially charged with involuntary manslaughter for the death of Hutchins.

On the other side, prosecutors maintain Baldwin is still responsible for ensuring the safety of his prop gun during filming. “It was Alec Baldwin's responsibility to handle his real prop gun safely and not point the gun at anyone, let alone two people simultaneously,” Morrissey stated. This emphasis on accountability adds to the already intense scrutiny surrounding Baldwin and his actions.
