In its depiction, the AI included verifiable facts from Holmen’s life, such as true details regarding the number and genders of his children and even his hometown of Trondheim. The portrayal painted a scenario where Holmen was sentenced to 21 years in prison—another fabricated detail compounding the emotional and reputational damage inflicted.

This striking incident has drawn the attention of Noyb, the European Center for Digital Rights, which is taking the matter seriously, as this unfortunate blend of accurate personal information and false accusations appears to violate the General Data Protection Regulation (GDPR). Joakim Söderberg, a data protection lawyer with Noyb, emphasized that the GDPR mandates that personal data must be accurate. He stated, "Personal data must be precise. And if they are not, users have the right to modify them to reflect the truth. Simply showing ChatGPT users a small disclaimer that the chatbot may make mistakes is not enough." His comments highlight a critical gap in accountability regarding the output of AI models—outcomes that could significantly impact a person’s life.

As the situation unfolded, the affected user took action by filing a privacy complaint against OpenAI, the organization behind ChatGPT. Noyb clarified that the specific timing of the initial query was prior to the system integrating web-search capabilities—interrogating how far AI's knowledge can stretch and whether it can accurately update its records responsibly.
