This determination addresses the tragic incident involving Francisco Pena, who wielded a knife and directly threatened his ex-girlfriend, leading to his death at the hands of Sparks Police.
On the evening of the shooting, Sparks Police responded to reports of domestic violence at 1625 Merchant Street. Officers Britt Brown and Tom Radley arrived just before 8 p.m., where they encountered Pena standing at the doorway screaming and brandishing a knife. Despite officers’ repeated commands to drop the weapon and show his hands, Pena responded with hostility, still gripping the knife as well as exhibiting threatening behavior.
District Attorney Chris Hicks issued a comprehensive 29-page report examining the incident, which highlighted the officers’ urgent responses. After several seconds of non-compliance from Pena, Officer Brown discharged his rifle and Officer Radley fired his sidearm. Pena was struck by their gunfire, dropped the knife, and was later declared dead after being transported to Renown Hospital.
According to the investigation's findings, Pena had been drinking and was enraged due to jealousy over his ex-girlfriend’s new relationship. The woman had entered her apartment only to be followed by Pena, who assaulted her and took her phone as part of the altercation before the terrifying confrontation with police ensued. Meanwhile, another legal development has emerged from Lafayette, Indiana, where Charles Seymour Bressler has opted to plead guilty to lesser charges following his initial murder charges stemming from the 2022 homicide of Terry Robinson. Bressler was originally charged with three counts of murder and attempts to deal methamphetamine but has reached a plea agreement admitting to low-felony charges of assisting a criminal and drug possession instead. Robinson's death was precipitated by suspected drug dealings gone wrong.
