North Carolina GOP Executes Power Grab After Elections

Republicans override governor's veto to seize control over state elections and limit powers of incoming Democrats

North Carolina has hit the headlines recently as the Republican-led state legislature has moved swiftly to enact significant changes affecting the power dynamics within its government, particularly aimed at removing authority from the newly elected Democratic officials.

This controversial political maneuver came just after the November elections, when Democrats marked notable victories, securing key offices including the governorship, which saw Democrat Josh Stein rise to the role, succeeding Roy Cooper. Democrats also won the lieutenant governor's seat and state attorney general's office, thereby breaking the Republican supermajority control established over the past decade.

Yet, instead of regrouping or reassessing their strategy, GOP lawmakers chose to double down. Over recent weeks, they have scrambled to push Senate Bill 382 through the General Assembly. This bill, couched under the guise of hurricane relief following Hurricane Helene, has turned out to be much more than just aid for storm victims; it's laden with provisions meant to significantly curtail the administrative powers of incoming Democratic officials.

"Today, Governor Cooper and I have taken legal action to stop the legislature’s unconstitutional and dangerous power grab," stated Attorney General Josh Stein about the bill's passage. This legislation transfers the responsibility of appointing state and county boards of elections from the governor to the state auditor, who is now Republican Dave Boliek. This would drastically alter the partisan balance of power overseeing elections, likely ensuring Republican dominance until 2028.

Following the passage of SB 382, protests erupted outside the North Carolina General Assembly, signaling public discontent with what many are calling blatant voter suppression tactics. With chants reverberated through the halls, protesters argued this legislation is less about hurricane relief and more about securing GOP power. Karen Ziegler, lead organizer for Democracy Out Loud, branded the measure as part of the Republicans' "MAGA wishlist" aiming to suppress voter turnout across the state.

Notably, the elections board is responsible for certifying results, supervising local boards of elections, and adjudicating campaign complaints. The shift means local elections will now operate under regulations decided by Republican appointees—affecting everything from the number of voting sites available to early voting hours, which are particularly significant for communities of color and low-income voters.

The shift away from the governor’s appointment authority follows previous, unsuccessful attempts by the GOP to wrest control over election oversight, including similar moves pre-2018 which met with public and judicial backlash.

Democratic state Senator Graig Meyer expressed outrage over the developments, emphasizing how this bill disregarded the voters’ choice made at the polls. According to him, "To take it away and give it to their new favorite Republican elected official is just direct disdain for the voters’ will.”

With various provisions tucked within the hurricane aid bill, the legislation includes measures to shorten the time allowed for voters to request absentee ballots and gives counties significantly less time to count those ballots. This impending restriction poses additional barriers for voters who already face numerous hurdles during election seasons.

Further complicaling the situation, the new law strips the incoming Democratic attorney general of traditional powers by limiting his ability to advocate effectively on behalf of consumers, muting potential challenges to state rules on various pressing issues like energy pricing.

This kind of legislative chaos sparks memories of similar actions taken against Governor Cooper shortly after his election victory in 2016, where the legislature attempted to diminish his powers, which resulted then is widespread protests and public outcry. Observers of North Carolina politics have expressed concern over the long-term ramifications of such sweeping decisions and whether they might lead to future legal challenges. Attorney Kym Meyer, who has represented voting rights cases previously, believes SB 382 will undoubtedly find itself embroiled in litigation shortly after its implementation.

"This action item today is going to be critically important to ensuring North Carolina continues to be able to deliver victories for Republicans up and down the ticket," House Speaker Tim Moore remarked, alluding to underlying political motives embedded within the legislation.

Meanwhile, public figures such as Governor Cooper and Attorney General Stein have remained vocal about fighting the measures and asserting their commitment to safeguarding democratic processes as they prepare for legal challenges. The dichotomy expressed between political aims and voter needs encapsulated by these opposing narratives feeds growing fears about the erosion of democratic practices.

Moving forward, the state will brace for potential shifts not only within its administrative framework but also concerning public reaction as this struggle between partisan interests and the electorate’s voice continues to play out. Governor-elect Stein asserts: "North Carolina deserves leaders who truly prioritize the welfare of its citizens, rather than partisan objectives masquerading as public service."

With the impending legislative session, all eyes will be on North Carolina as it grapples with the fallout from these actions, and as judges will soon have to weigh-in on what many believe to be unprecedented power grabs.
