Legal Battle Rages For José Antonio Cabrera

Father of Tragically Deceased Daughter Challenges Ayuntamiento de Bonares Over Negligence

José Antonio Cabrera's quest for accountability following the tragic death of his daughter, Fuente Clara, has led him deep within the legal system of Bonares, triggering a high-profile investigation. Cabrera, who is grieving the loss of his 25-year-old daughter since her horrific accident caused by loose animals on the road, has found himself under scrutiny from the local government.

On September 17, 2024, Cabrera provided important evidence to the court during the trial surrounding the circumstances of his daughter’s death. This evidence comprised nearly twenty police reports retrieved from the local government, which allegedly demonstrate the negligence of Cipriano Domínguez Jiménez, the accused responsible for the accident involving the stray animals. Cabrera contends these documents are pivotal to proving the case, but they have also placed him at the center of controversy.

Mayor Juan Antonio García responded to the situation, asserting, "En ningún momento el Ayuntamiento ha denunciado a José Antonio Cabrera," indicating the investigation focused not on Cabrera himself but rather on the 'disappearance' of sensitive police documentation. The mayor revealed this documentation concerns daily police reports containing delicate information, including local citizens' complaints against the same person charged with Fuente Clara's tragic death.

García described the situation as very serious, categorizing it as “un delito contra la protección de datos” (a violation of data protection laws). He emphasized the need to understand who had accessed these documents without proper authority, citing the sensitivity of the information involved. "Hay datos bastante delicados, sobre todo con partes policiales diarios," he noted, expressing his concerns over the improper management of sensitive data.

Sources close to the investigation reveal how Cabrera received the files on the USB drive, which were left anonymously at his home. Following the documents' delivery, Cabrera immediate handed them over to the court as evidence he believed was necessary to substantiate his allegations against Domínguez.

Cabrera's remarks echo his frustrations, stating, “No entiendo como siendo víctima de la muerte de mi hija, soy investigado por denuncias del propio Ayuntamiento de Bonares.” This condemnation of the local government suggests Cabrera isn't merely fighting for justice for his daughter, but also aims to hold the authorities accountable for what he perceives as negligence and mishandling of public safety.

His lawyer, José Luis Orta, has criticized the Ayuntamiento for prioritizing the investigation of how the documents were leaked over the serious content contained within them. Orta expressed concern over the focus on guarding internal matters rather than addressing the pressing allegations pertaining to public safety. "El contenido del pen y sus archivos deja en una posición delicada al Consistorio por dejación de funciones," he stated, implying potential culpability on the part of the Ayuntamiento.

The police reports highlight Cipriano's consistent refusal to manage his animals responsibly, as evidenced by numerous complaints documented spanning back to 2021. Cabrera’s determination to expose what he claims is systemic negligence entangled with personal loss may lead to broader implications for the community as safety practices are called to scrutiny.

Through this fight, Cabrera not only seeks justice for his daughter but also aims to encourage dialogue about animal control and public safety within Bonares. His advocacy has drawn attention to the challenges families face when confronted with loss due to negligence.

The outcome of Cabrera's legal battle with the Ayuntamiento de Bonares remains uncertain, yet it undeniably highlights the vulnerabilities within the systems meant to protect citizens. This case encapsulates more than just one family's tragedy; it reflects on the shared responsibility of local authorities to safeguard public well-being.

While the investigation continues, the community watches closely, hopeful for answers and potentially significant reforms stemming from this heart-wrenching event. José Antonio Cabrera's voice will not be silenced easily; he remains resolute, declaring, "Habrá que plantearse una línea de actuaciones judiciales contra el Ayuntamiento y su figura representativa, el alcalde Juan Antonio García.”
