Justice Sought For Victims Of Club Q Shooting

Lawsuits filed against nightclub owners and El Paso County officials allege negligence and failure to enforce red flag laws

Filed with the U.S. District Court for Colorado, the lawsuits detail allegations of inadequate security measures at Club Q and accuse the El Paso County Board of County Commissioners, along with former sheriff Bill Elder, of refusing to enforce Colorado's “red flag” laws. These laws were enacted with the intention of preventing individuals who pose risks to themselves or others from obtaining firearms. According to the lawsuits, the systemic failures contributed significantly to the devastating shooting.

Between the two lawsuits, there are twelve plaintiffs who have suffered trauma and loss, including the families of the deceased and those who sustained serious injuries. They seek compensation not only for the medical expenses and lost wages incurred but also for the emotional distress and persistent psychological pain they have endured since the incident. "The Club Q shooting was perpetrated by the violent actions of a single individual," reads one of the documents. "[But] this tragedy was enabled by systemic failures, including law enforcement’s refusal to enforce Colorado’s Red Flag Law... and inadequate security measures at Club Q."

During the shooting, patrons bravely intervened, subduing the assailant, who was later sentenced to multiple life terms without the possibility of parole. A significant focus of the lawsuits highlights the claims surrounding the lack of security personnel at Club Q, which is said to have decreased its security team from five to just one guard shortly before the shooting. This singular security guard, who also held responsibilities as a barback and food runner, reportedly had not undergone the necessary background checks or training to fulfill the role adequately.

The legal documents assert, "But for these inadequate and defective security policies, procedures, and safeguards employed by Club Q, among other negligent and wrongful conduct, the mass shooting would not and could not have occurred." They contend the nightclub's changes were driven by financial motivations rather than the legitimate need for patron safety.

Further complicity lies with the actions, or lack thereof, of the El Paso County officials. After the assault and kidnapping incident involving the shooter, who made alarming threats and collected weapons over time, it was alleged by some plaintiffs the sheriff’s office failed to utilize the red flag laws to disarm them. The 2019 red flag law allows for the temporary confiscation of firearms from individuals deemed to be potential threats. But the El Paso County Board had declared itself a “Second Amendment preservation county”, openly opposing such laws, which the lawsuits argue only heightens the vulnerability of individuals to gun violence.

Further details from the lawsuits reveal concerning patterns leading up to the mass shooting. While authorities were mindful of the shooter's previous threatening behavior, described as not only alarming but also escalatory, they did not proceed with any legal actions to disarm them after the shooter was implicated and arrested for violent threats to their family members.

One of the lawsuits states, "Elder’s deliberate policy of non-enforcement of Colorado’s Red Flag Law, coupled with his conscious disregard of explicit and credible threats, demonstrated a willful indifference to Plaintiffs’ safety and constitutional rights." This indictment of the local authorities reveals the extent of the plaintiffs’ frustrations, asserting their constitutional rights to safety and full governance were undermined by officials who seemingly chose to neglect the laws meant to protect citizens.

Among the plaintiffs are Barrett Hudson, who bears the physical scars of the shooting, still carrying some of the bullets within him. This Tuesday marks the second anniversary of the shooting, and it’s on this date when Hudson and other survivors are set to hold a news conference discussing not just their legal claims but the enduring pain they've borne since the night their lives were irrevocably changed.

The lawsuit is not merely about seeking damages; it’s about accountability. The plaintiffs want to shed light on how institutional failures could potentially lead to another tragedy if left unaddressed. With the new filings, the tragedy of the Club Q shooting calls for not only reflection but proactive measures to understand and prevent such incidents from repeating.
