The complaint, filed with New Mexico’s child protective services, asserts that Busfield’s conduct included inappropriate touching on multiple occasions, both on set and at social functions. One child told a social worker that he suffers nightmares about Busfield and has been diagnosed with post-traumatic stress disorder and anxiety.

Professionals at the University of New Mexico Hospital, who first alerted authorities in November 2024, suggested the boys “were groomed,” according to the affidavit cited by NBC News. The document further alleges that Busfield told the children to call him "Uncle Tim" and would tickle them on their stomachs and legs. During a phone interview with detectives in November 2025—where Gilbert reportedly listened in via speakerphone—Busfield stated, "It was highly likely that he had physical contact with the boys," but claimed, “I don’t remember those boys. No, I don’t. I don’t actually, I don’t remember it, if it happened. I don’t remember overtly tickling the boys ever, but it wouldn’t be uncommon for me.”

The affidavit also details that Busfield and Gilbert bought the boys Christmas gifts and attended several social functions with them, acknowledging a relationship beyond the professional. Despite this, Gilbert is not accused of any wrongdoing.

The allegations have cast a long shadow over Busfield’s accomplished career. Known for his roles in The West Wing and Thirtysomething, Busfield was a director and producer on The Cleaning Lady until the show’s cancellation in June 2025. Fox and Warner Bros. Television, in a joint statement on January 11, 2026, emphasized, “The health and safety of our cast and crew is always our top priority, especially the safety of minors on our productions. We take all allegations of misconduct very seriously and have systems in place to promptly and thoroughly investigate, and when needed, take appropriate action. ... We are aware of the current charges against Mr. Busfield and have been and will continue to cooperate with law enforcement.”

Warner Bros. Television began its own investigation after an anonymous tip to the SAG-AFTRA hotline in February 2025. The tip referenced a December 2024 incident in which Busfield allegedly kissed a minor male on the face in the hair and makeup trailer. The studio’s inquiry reportedly uncovered photographs of Busfield “tickling and caressing the head and body of minor boys.”

As of January 12, 2026, Busfield had not been placed in police custody, and the allegations remain unproven in court. His legal representative has not responded to media requests for comment.

For Gilbert, the fallout has been both public and deeply personal. Her personal Instagram account, once a hub for fans, now displays the message: “Profile isn’t available. In a July 2025 podcast appearance, Gilbert reflected on her marriage, saying, “I think it’s part and parcel of the fact that it’s a partnership, that we do everything with the other one in mind, and we are very considerate of one another and we respect each other immensely. And so there are no decisions that are made singularly.”

Her advocacy for child safety and her own experiences as a young actress have added a poignant layer to the current crisis. In November 2025, Gilbert used her Instagram platform to push back against public figures who minimized the seriousness of sexual abuse involving minors. She recalled being a 15-year-old actress expected to “fall in love with” and kiss an older man on-screen, praising those who made her feel safe and urging caution with words that might diminish the harm of abuse.

The case has also raised questions about the entertainment industry’s duty of care. Fox and Warner Bros. have reiterated their commitment to child safety, but the unfolding investigation reveals the complexities of protecting minors in high-profile productions. The affidavit notes that the boys’ mother reported the alleged abuse after her children disclosed their experiences to therapists, and that the investigation involved interviews with multiple cast, crew, and medical professionals.

Busfield’s legal troubles are not entirely unprecedented. In 1994, he was accused of sexually assaulting a 17-year-old actor on the set of Little Big League. Busfield denied those claims and sued the accuser for defamation; the case ended with a settlement, and Busfield was ordered to pay $150,000.

For now, the allegations against Busfield remain just that—allegations. No conviction has been made, and the legal process is ongoing.
